International Purchase and Sales ConditionsThe European Peat and Growing Media Association, EPAGMA, has drafted and adopted International Purchase and Sales Conditions, which it encourages its own member companies as well as other interested parties to use in international business operations and transactions. You can download the Conditions for your own use through the links provided here below. These Conditions are intended as a model of best practice, but if necessary, they can be adapted to reflect specific situations/transactions. The International Purchase Conditions are valid for all business with suppliers and other contractors.
The Conditions include clauses on offers; orders; prices & payment; delivery deadlines and dates; delivery, transport, packaging and passage of risk; quality and quality assurance; insurance, defects and recourse; products liability and insurance coverage; trademarks; force majeure; retention of title; trade secrets; arbitration and place of performance; and other liability.
The International Sales Conditions are valid for international deliveries.
The Conditions include clauses on consultation; contract execution; payment conditions; VAT; set-off; delivery area, measurement methods and trademark rights; delivery and terms of delivery; documents, transport and packaging; suspension of delivery obligations; force majeure; non-conforming and defective goods; contract cancellation; damages; retention of title; indemnity; place of performance, payment and fulfilment; applicable law and legal venue; and supplied goods.
